Jeffrey Tambor hasn’t been written out of Arrested Development.

On Friday, a Netflix spokesperson confirmed to TV Guide that the actor — who has been accused of sexual misconduct and already was ousted from Transparent as a result — will appear in the comedy series’ upcoming fifth season.

Last November, Tambor, who plays Bluth family patriarch George Sr. as well as his twin brother Oscar on Arrested Development, was accused of sexual misconduct by women he worked with on Transparent. His assistant on the show accused him of sexually harassing her, and actress Trace Lysette said he once cornered her and thrust his penis into her hip. Both women are trans and Tambor won two Emmys for his performance in Transparent which he dedicated to trans people. Later, a makeup artist on the 2001 movie Never Again also accused him of sexual harassment.

Tambor said he was sorry “if any action of mine was ever misinterpreted by anyone as being sexually aggressive or if I ever offended or hurt anyone,” but he denied the misconduct allegations. In November he said he was leaving the Transparent, only to walk back that claim in December. Either way, his contract was not renewed, and Season 5 of Transparent is proceeding without him.

But the Arrested Development team is apparently standing by him. His co-stars David Cross and Jason Bateman have voiced their support for him publicly. However, co-star Alia Shawkat said that she hopes the allegations will be “handled legally, the way it should be,” and that she supports “the voices of the victims.” Arrested Development also finished filming in November 2017, the same month the accusations against him came out.

Arrested Development Season 5 premieres on Netflix “real soon.” The streaming service also released a “remixed” version of Season 4 on Friday.
